1. Agreement
These Terms govern your use of GenzPlays (the "Service"), operated by Mirja Minhajuddin, Baduria, North 24 Parganas, West Bengal, India. By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Community Guidelines. If you do not agree, do not use the Service.
2. Who may use GenzPlays
- You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher.
- If you are under 18, you may only use the Service with the consent of a parent or legal guardian, who accepts these Terms on your behalf.
- You must not be barred from using the Service under the laws of your country, and you must not have been previously terminated for policy violations.
3. Your account
Accounts are created through Google Sign-In. You are responsible for activity on your account. One person may hold one account unless we approve otherwise. Do not share, sell or transfer your account or channel handle.
4. Your content
4.1 You keep ownership
You retain all ownership rights in the content you upload. Uploading does not transfer ownership to us.
4.2 Licence you grant us
By uploading, you grant GenzPlays a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, encode, adapt for streaming, distribute and display your content, solely for the purpose of operating, promoting and improving the Service. This licence ends when you delete the content, subject to a reasonable delay for backups and any retention required by law.
4.3 Licence you grant other users
You grant every other user a non-exclusive, royalty-free licence to view and stream your public content through the Service.
4.4 Your promises
You confirm that you own or have all necessary rights to the content you upload, including music, footage, images and any third-party material, and that your content does not infringe anyone's rights or break any law.
5. What you must not do
- Upload content that breaks our Community Guidelines or any law.
- Infringe copyright, trademark or other intellectual property rights.
- Artificially inflate views, watch time, likes, subscribers or ad impressions by any means, including bots, click farms, automated scripts, incentivised traffic or paid engagement.
- Attempt to access accounts, servers or data you are not authorised to access, or interfere with the Service's operation.
- Scrape, download or redistribute other users' content outside the features we provide.
- Impersonate any person, brand or organisation, or misrepresent your affiliation with them.
- Reverse-engineer, decompile or create derivative works from the app, except where the law expressly permits it.
6. Enforcement
We may remove content, restrict features, withhold earnings or suspend or terminate an account that breaches these Terms. In most cases we apply the strike system first; serious or repeated violations, and violations involving child safety, may result in immediate permanent termination without a strike. You may appeal any decision within 15 days.
7. Monetization
Monetization is optional, is not a right, and is governed by our Monetization Policy and Payout Policy. We may pause, review or end monetization for any account where we detect invalid traffic, policy violations or fraud.
8. Advertising
The Service is supported by advertising. By using the Service you agree that ads may be shown before, during or alongside content. See our Advertising Policy.
9. Changes to the Service
We are continuously developing GenzPlays and may add, change or remove features at any time. We may also stop offering the Service, in whole or in part, with reasonable notice where practicable.
10. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied. We do not guarantee uninterrupted access, freedom from errors, that content will be available indefinitely, or any particular level of earnings.
11. Limitation of liability
To the fullest extent permitted by law, GenzPlays and its operator will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total aggregate liability to you for any claim will not exceed the greater of (a) the total amount we paid you in the 12 months before the claim, or (b) USD 100.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to indemnify and hold harmless GenzPlays and its operator from any claim, demand, loss or expense (including reasonable legal fees) arising out of content you upload, your use of the Service, or your breach of these Terms or the law.
13. Third-party content
GenzPlays hosts content created by users. We do not endorse, and are not responsible for, opinions or claims made in user content. As an intermediary we act on notice; see our Copyright Policy.
14. Termination by you
You may stop using the Service and delete your account at any time. See Account & Data Deletion.
15. Governing law
These Terms are governed by the laws of India. Courts at Kolkata, West Bengal will have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
